In no event shall Realomate or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Realomate's website, even if Realomate or a Realomate authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

Realomate does not warrant that any of the materials on its website are accurate, complete or current. Realomate may make changes to the materials contained on its website at any time without notice. However Realomate does not make any commitment to update the materials.

Realomate has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Realomate of the site. Use of any such linked website is at the user's own risk.
7. Modifications
Realomate may revise these terms of service for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these terms of service.
8. Lead Marketplace
Realomate operates a lead marketplace where users can buy and sell real estate leads. By using the marketplace, you agree to the following terms:
For Sellers
- You must have legitimate ownership or rights to sell the lead information you list.
- All lead information must be accurate and truthful to the best of your knowledge.
- You agree to provide valid contact information for leads you sell.
- Leads are subject to verification by Realomate's automated systems. Verification tier (Contact Verified, AI Analyzed, Self-Reported) reflects the level of verification performed.
- Sellers must connect a Stripe account to receive payouts. Payouts are processed according to Stripe's standard payout schedule.
- Realomate reserves the right to remove listings that violate these terms or contain fraudulent information.
For Buyers
- Lead purchases are subject to our Lead Quality Guarantee. You may request a refund within 48 hours if contact information is verifiably invalid. See Section 10 for full details.
- Lead quality and conversion rates are not guaranteed. Verification scores and tiers are informational and do not constitute a warranty of lead quality or intent.
- You agree to use purchased lead information only for legitimate real estate business purposes.
- You may not resell or redistribute purchased lead information without explicit permission.
- Exclusivity types (Exclusive, Time-Exclusive, Non-Exclusive) indicate how the lead may be sold to other buyers. Exclusive leads are sold only to you; Non-Exclusive leads may be sold to multiple buyers.
Platform Fees
Realomate charges a platform fee on marketplace transactions. Current fee structures are displayed during the listing and purchase process. Fees are subject to change with notice.
Dispute Resolution
In the event of a dispute between buyers and sellers, Realomate may, at its sole discretion, mediate disputes but is not obligated to do so. Realomate is not liable for losses resulting from inaccurate lead information, failed conversions, or disputes between marketplace users.
9. Artificial Intelligence Features
Realomate incorporates artificial intelligence (AI) features to enhance your experience. By using these features, you agree to the following:
AI-Powered Features
Realomate uses AI to provide:
- Lead Scoring: Automated analysis and scoring of leads based on available data and engagement signals.
- AI Insights: Automated recommendations and observations about your leads, pipeline, and business performance.
- Content Generation: AI-assisted drafting of messages, emails, and social media content.
- Lead Verification: AI analysis of lead information and evidence to assign verification tiers in the marketplace.
- Audience Suggestions: AI-powered recommendations for targeting and segmentation.
- Workflow Automation: AI-assisted creation and optimization of automated workflows.
AI Limitations and Disclaimers
- AI-generated content and recommendations are provided as suggestions only. You are responsible for reviewing and approving all AI-generated content before use.
- AI lead scores and insights are informational and do not guarantee lead quality, conversion likelihood, or business outcomes.
- AI systems may produce inaccurate, incomplete, or biased outputs. Realomate does not warrant the accuracy of AI-generated content.
- You should not rely solely on AI recommendations for important business decisions.
- AI features may be modified, improved, or discontinued at any time without notice.
Your Responsibilities
- You are responsible for all content you send or publish, even if initially drafted by AI.
- You agree not to use AI features to generate spam, misleading content, or content that violates applicable laws.
- You acknowledge that AI-generated content should be reviewed for accuracy, appropriateness, and compliance with real estate regulations before use.
10. Refund Policy
Subscription Plans
- Free Trial: All paid plans include a 7-day free trial. No payment is charged during the trial period. You may cancel at any time during the trial without being charged.
- Monthly Plans: Monthly subscriptions are non-refundable. You may cancel at any time and your subscription will remain active until the end of the current billing period. No further charges will be made after cancellation.
- Annual Plans: If you cancel an annual subscription within 30 days of purchase, you are eligible for a pro-rated refund for the unused portion of your plan. After 30 days, annual subscriptions are non-refundable but you may continue using the service until the end of your billing period.
- Downgrades: If you downgrade to a lower plan, the change takes effect at the start of your next billing cycle. No refunds are issued for the current billing period.
Marketplace Lead Purchases
- Lead Quality Guarantee: We stand behind the quality of leads on our marketplace. If you purchase a lead and the contact information is verifiably invalid, you may request a refund within 48 hours of purchase.
- Valid refund reasons include:
- Phone number is disconnected or not in service
- Email address bounces or is undeliverable
- Contact information is clearly fabricated (e.g., fake name, nonsensical data)
- Duplicate lead (you already purchased the same lead previously)
- Refunds are not available for:
- Leads where the contact did not respond to buyer outreach. “Verified” means the contact information was validated and the lead responded to our verification message at the time of listing — it does not guarantee ongoing responsiveness to buyers.
- Leads where the contact changed their mind or is no longer interested
- Leads that did not result in a closed transaction
- Requests made more than 48 hours after purchase
- How to request a refund: Submit a refund request through your Realomate dashboard within 48 hours of purchase. Include the reason for your request and any supporting evidence (e.g., screenshot of bounced email, call log showing disconnected number). Realomate will review the request and process eligible refunds within 5 business days.
General
- All refunds are processed to the original payment method.
- Realomate reserves the right to deny refund requests that appear fraudulent or abusive.
- This refund policy may be updated from time to time. The version in effect at the time of your purchase applies.
11. Text Messaging (SMS/MMS) Terms
Realomate offers AI-assisted SMS drafting to help real estate agents communicate with leads and clients. By using these features, you agree to the following terms.
Service Description
Realomate uses a "Bring Your Own Messaging" (BYOM) model for SMS. Our AI generates suggested message drafts based on lead context, which the agent reviews and sends from their own personal device and phone number. Realomate does not send SMS messages on behalf of agents and does not operate a shared phone number for outbound messaging.
Agent Responsibility
When an agent sends messages from their personal device using Realomate-generated drafts, the agent is solely responsible for:
- Ensuring TCPA compliance for all messages sent from their personal number
- Obtaining and maintaining proper consent for direct outreach from their personal number
- Honoring opt-out requests received on their personal number
- Ensuring message content complies with all applicable laws and carrier rules
Realomate Responsibility
Realomate generates AI draft text and retains a copy of the generated draft for the agent's records. Realomate does not transmit, route, or deliver SMS messages, and does not control, monitor, or assume liability for messages agents send from their personal devices.
Service Suspension
Realomate reserves the right to suspend or terminate access to SMS drafting features for agents who use the service to generate content that violates applicable laws, consent requirements, or carrier rules. Suspension may be immediate and without prior notice in cases of egregious violations.
Acceptable Use
You may not use Realomate's SMS drafting features to create spam, harassment, threats, illegal content, or any content prohibited by wireless carrier rules. Drafted messages must be related to legitimate real estate business purposes.
Carrier Liability
Carriers (e.g., T-Mobile, AT&T, Verizon) are not liable for delayed or undelivered messages. Because Realomate does not transmit messages, carrier delivery issues are between the agent and their wireless provider.
Disclaimer
Realomate is not liable for SMS delivery failures, carrier filtering, or any issues arising from messages sent by agents from their personal devices. Realomate provides AI-generated draft suggestions only and does not guarantee message delivery.
Privacy
Phone numbers stored in your CRM and AI-generated draft content are handled in accordance with our Privacy Policy.
12. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of California and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.
